レジットスクリプトは、新たな不正オンライン薬局のネットワークを特定しました。このネットワークは、50以上のウェブサイトから成っており、処方薬を処方せんなしで違法に日本に向け販売しています。この５０以上のインターネット薬局ウェブサイトの背後にある会社の名称から、私たちはこのネットワークを「ロイユニオン（Roy Union Limited）」と呼びます。ロイユニオンネットワークは10ほどの主要なオンライン薬局のウェブサイトと、多数のアフィリエイトウェブサイトから成り立っています。ロイユニオンが経営する主要なウェブサイトのいくつかの例をあげると、オオサカ堂(osakado.com)、 JISA （jisapp.com）、オランダ屋 (orandaya.com)、彩香 (m-hk.com)があります。

日本では処方薬のオンライン販売は認められていません。例外として「個人輸入」がありますが、この例外はきわめて狭く、この「個人輸入」の規則は、多くの不正オンライン薬局によって乱用されています。日本の薬事法では、未承認薬を宣伝する事は違法です。ウェブサイト上で少しでも未承認医薬品を宣伝すると違法行為となります。ロイユニオンのウェブサイトは「個人輸入代行業」であり、合法であると明記しているものの、個人輸入の規則には全く従っていません。

「オランダ屋」や「オオサカ堂」といったウェブサイトの名前を使っているにもかかわらず、Roy Union Limitedはオランダにも大阪にも位置しません。この会社は香港を本拠地としていて、香港、シンガポール、アメリカ、タイ等の国々から発送しているようです。「彩香(m-hk.com)」のウェブサイトには、Roy Union Limitedと、その販売業者Succeed Holdings Ltd.の会社のアドレスなどが記載されています。

ロイユニオンが運用する数々のウェブサイトでは、それぞれのウェブサイトで似たような商品が販売されています。しかし、様々な消費者を引きつけるため、ウェブサイトデザインが異なります。例えば、彩香(m-hk.com)やオランダ屋(orandaya.com)は女性客へ向けたデザインとなっている一方、オオサカ堂は男性客をターゲットにしたものとなっています。しかし、消費者がどのウェブサイトを選ぼうと構わないのです。結局のところ、すべての利益は ロイユニオンに行くからです。

何を販売しているのか？なぜ「不正」なのか？

このネットワークのウェブサイトは 、勃起不全薬、抗鬱剤、避妊薬、糖尿病の治療薬、抗がん剤、抗エイズ薬、さらには、向精神薬の広範囲に及ぶ商品を扱っています。また、ロイユニオンは、うさパラ（usapara.com）のような動物用処方せん医薬品を販売するウェブサイトも運営しています。

不正オンライン薬局はよく「薬の個人輸入」は日本の法律で認められていて、合法なビジネスだといいます。しかしそれは本当ではありません。そして、不正オンライン薬局は、彼らの販売する薬は「本物」だといいますが、それもおそらく事実ではないでしょう。これらのウェブサイトで購入する薬は、医者の処方せんをもとに近所の薬局から入手するものとは異なります。なぜなら、ウェブサイト上で販売されている処方薬は規制されていないからです。認定された製造業者によって製造されておらず、品質管理もなされていない、という事です。

私たちから日本国民へのアドバイスはごく簡単なものです。「処方薬はオンラインで買ってはいけません」。日本で処方薬を販売する正当なオンライン薬局というものは存在しません。そして、処方薬を販売する日本語のウェブサイトで、日本の厚生省が承認しているものはありません。もし正当なオンライン薬局だと主張するウェブサイトを見つけたら、自分に問いかけてみてください。「なぜ商品が本物だと分かるのか？」「誰がどこで薬を製造しているのか？」「薬には何が入っているのか？」「誰が品質管理をしているのか？」残念ながら、知るすべはありません。ロイユニオンのような ネットワークが経営するウェブサイトから処方薬を買うことは、あなたの命を危険にさらすことになりかねません。

LegitScript has identified a new rogue Internet pharmacy network of more than 50 websites that illegally ship drugs into Japan without requiring a valid prescription. As this network, and other operators of Internet pharmacies should know, the online sale of prescription medications is not permitted in Japan. This network, which we refer to as Roy Union Limited (the name of the company behind these Internet pharmacies), consists of 45 websites that are the businesses of interest and 10 rogue Internet pharmacies that are “anchor” websites. A few of the anchor websites are osakado.com, jisapp.com, orandaya.com and m-hk.com.

Japan doesn’t allow online sales of any prescription drugs. There is a small exception for “personal importation,” but the exception is very narrow — and many rogue Internet pharmacies exploit this rule. Basically, if a website advertises unapproved drugs at all, it’s considered to be illegal under Japanese law. Of course, none of the Roy Union Limited Network websites are following the rules for personal importation, despite claiming that they do. Websites in the network display a copyright notice along with 個人輸入代行 (“personal import agency”), the name of the narrow prescription drug importation exception.

Despite using misleading website names — such as orandaya.com (“Orandaya” translates to “Holland store”) or osakado.com (“Osakado” translates to “Osaka store”) — Roy Union Limited is not located in either Holland or in Osaka, Japan. The company is based in Hong Kong, and it claims to ship medicines from Hong Kong, Singapore, the US, Thailand and other places. Roy Union Limited and its distributor, Succeed Holdings Ltd. (also in Hong Kong), are identified in this corporate profile, found on the website m-hk.com:

Roy Union Limited websites mostly sell the same products but have different designs that are meant to attract various types of customers. For example, the website design for m-hk.com and orandaya.com is geared toward female customers, whereas osakado.com targets male customers. But it doesn’t matter which one customers choose because all the profits go to the same place: the network Roy Union Limited.

What do they sell, and why they are rogue?

The websites in this network carry products that run the gamut from erectile dysfunction drugs, anti-depressants, birth control pills and diabetes medicines  to cancer drugs, HIV drugs and even psychoactive high products. The network also has online rogue animal pharmacies, such as usapara.com.

Rogue Internet pharmacies often say “personal importation of medicines” is allowed under Japanese laws and therefore their business is legal. That is not true. Rogue Internet pharmacies also say their medicines are “genuine,” but that is not necessarily true either. Medicines purchased from these websites are different from what you get from your local pharmacies with doctors’ prescriptions because most likely they are unregulated, which means they are not made by certified manufacturers and they are not quality controlled.

Our advice to the Japanese public is very simple: Do not buy prescription medicines online. There is no “legitimate online pharmacy” that sells prescription drugs in Japan, and none of the Japanese-language websites that sell prescription drugs are approved by the Japanese Health Ministry. If you find a website that claims it is a legitimate Internet pharmacy, ask yourself: How will I know if the product they send is genuine? Who makes the medicines, and where? What’s in the medicine? Who is doing the quality control? Unfortunately, there is no way to know. Buying prescription medicines from websites that are run by networks such as Roy Union Limited could put your life at risk.

レジットスクリプトは、処方箋医薬品を扱う日本語オンライン薬局の実態について調査を行いました。日本は、処方箋医薬品の世界第二番目に大きな市場です。レジットスクリプトは2013年に、次の二点に関して、調査を行いました。

• 日本語の検索結果に現れる不正オンライン薬局の実態。
• 検索結果に現れる不正オンライン薬局ウェブサイトは、どんな犯罪ネットワークに属しているのか。

調査報告書の前半では、日本のオンライン薬局に関する法規をまとめました。OTC医薬品の一部を除いては、日本では処方箋医薬品を販売するオンライン薬局は違法です。（最近の最高裁の判決により、OTCのオンライン販売は合法になる方向にありますが、処方箋医薬品のオンライン販売は違法です。）他の国と同様、日本で薬局を開設するためには薬局許可が必要です。薬局で販売される医薬品は承認を受けていなければなりません。また、処方箋は医師免許を持った医師が直接診察をして発行しなければなりません。

基本的に、処方箋医薬品を輸入する事は違法です。厚生労働省は非常に狭い範囲での個人輸入を認めています（mhlw.go.jp/kinkyu/diet/tuuchi/0828-4.html）調査報告書でも述べたように、不正オンライン薬局は、レジストラ、銀行、また、一般市民に対して、 この厚生労働省の文書を用い、「日本では処方箋医薬品の輸入は認められており、オンライン薬局の経営は合法である」と説明する事がよく見られます。

問題は、日本の法規はそう定義しているのではない事です。我々の調査で示されたように、この個人輸入の規則は狭く、この規則に従っているオンライン薬局はごく一部に限られています。2,345件の検索結果中、たった１つのウェブサイト、0.1％だけが厚生労働省の規則に従っています。その他は厚生労働省の規則に全く従っていませんでした。

日本におけるオンライン薬局市場

以下の図は、厚生労働省のホームページに記載してあるものです。 

日本の薬事法68条は、未承認医薬品の広告を禁じています。（例えば、日本ではバイアグラは25mgと50mgしか承認されていないため、バイアグラ100mgは純正品であったとしても、広告をする事は禁じられています。）不特定多数に未承認薬の輸入の「希望を募る」行為は禁じられています。業者は「代行」する事のみ可能であり、自ら医薬品を発送する事はできません。顧客が処方箋医薬品を配給する薬局などに連絡を取る手助けをする「受動的な第三者」としての営業のみ可能です。その逆の行為、つまり業者から顧客に購入を促す事はできません。

データの分析

レジットスクリプトのこの2013年の調査では、「リピトール　通販」や「レクサプロ　輸入代行」など、医薬品と薬局関係の検索語に対しての検索結果、2,345件を分析しました。処方箋医薬品の販売を目的とするウェブサイトのうち、厚生労働省のガイドラインに従っている割合を調べました。

2,345件の検索結果のうちの66％である1,553件が、処方箋医薬品の販売、または販売を促す事を目的とするウェブサイト、つまりオンライン薬局、または医院や製薬会社のウェブサイトでした。残りは情報サイト、個人のブログ、掲示板などの中立な立場のウェブサイトでした。

処方箋医薬品の販売、または販売を促す結果を出した1,553件のうち、1,454件は日本の法規に従わず、個人輸入代行業の規則にも従っていない不正オンライン薬局でした。その他の55件は医院のウェブサイトであり、オンライン販売は行っておらず、来院の患者に対しての処方のみです。ウェブサイトであり、オンライン販売は行っておらず、来院の患者に対しての処方のみです。34は製薬会社のウェブサイトであり、8はOTCのみを販売するウェブサイトでした。OTCを販売するウェブサイトの中には現在の時点で完全に合法だとは言えないものも含まれますが、最近の最高裁の判決により近いうちにOTCのネット販売の緩和が進むと予想される為、問題はないと判断しました。

処方箋医薬品をオンラインで販売していた検索結果のうち、「個人輸入代行業者」である可能性があったウェブサイトは、たった１つでした。これはトップページに未承認医薬品の名前や値段が記載されておらず、医薬品名や値段を見る為には、顧客が薬の名前の一部を入力しなければならなかった為です。日本語の処方箋医薬品に関する検索結果のうち、厚生労働省の処方箋医薬品の輸入に従っていると考えられたのは、たったの0.1%だけでした。それ以外は全て日本の法規に違反していました。

主な不正オンライン薬局ネットワーク

日本をターゲットとする主な不正オンライン薬局ネットワークについての調査も行いました。検索結果に現れた44％の不正オンライン薬局ウェブサイトは、以下の３つの不正オンライン薬局ネットワークのものでした。

1. ベストくすり (別名 ベストケンコー) ネットワークベストくすりは、現在はベストケンコーとして営業しており、 2,345のうちの 419を占めました。正当な結果である医院と製薬会社の検索結果の総数は、たった89だった事を見れば、このネットワークの大きさが分かるでしょう。言い換えれば、日本語の処方薬のインターネット検索において、ベストくすりのウェブサイトだけでも、正当な結果の５倍近くとなっています。 ベストくすり/ベストケンコーのネットワークについては、レジットスクリプトの過去のブログ記事 をご覧下さい。
2. ロイユニオン不正薬局ネットワーク ロイユニオンは中国から運営されていると考えられる不正薬局ネットワークです。 このネットワークの検索結果は183に及びました。これはベストくすり（ベストケンコー）の半分以下でしたが、それでも正当な医院や製薬会社などの全ての正当なウェブサイトの合計の倍以上の数になります。 ロイユニオンに関しては過去のブログ記事 を参照して下さい。
3. RxCash.biz　RxCash.bizは、イスラエルに拠点を置く多国籍犯罪集団であり、アメリカ、ヨーロッパ、日本、中東などをターゲットにしています。RxCash.bizは世界中で規制薬物を含む処方箋医薬品を、処方箋なしで販売しています。医薬品は承認されておらず、偽造品と考えられます。このネットワークのウェブサイトには、i-kusuri.jp や kenkostore.orgがあります。

日本人が知っておくべき重大な事実があります。それは、日本国民に向けて処方箋医薬品を売るウェブサイトは、「正当な薬局」、つまり、FDA（米国食品医薬品局）などの機関に認証を受けたアメリカアメリカの実店舗を持つ薬局やドラッグストアが、日本に向けて少し販売をしているという訳ではありません。実際には、 主もなく、社会構造にも属さない日本の昔の「浪人サムライ」 のように、多国籍犯罪ネットワークが、何の安全管理もなく運営しているのです。

Japan’s Yomiuri newspaper recently published an article about LegitScript regarding our Internet monitoring methods.

Japan has the second-largest pharmaceutical market in the world, after the United States. Over the past two years, LegitScript has closed more than 400 illegal Japanese-language websites selling prescription medicine in a way that violates Japanese laws and regulations, and puts Japanese residents’ health and safety at risk.

Japan’s Congress is in the process of formulating new laws and regulations regarding the online sale of medicines, responding to the recent removal of a ban on the online sales of over-the-counter products imposed by the Japanese Supreme Court. In response, websites that illegally sell prescription medicine online, such as BestKenko, have started to target the Japanese market in new ways, such as displaying OTC products instead of prescription drugs at the top of their page, and selling prescription drugs illegally to the customers who seek OTC drugs. We believe that Japan will need more active monitoring in the coming year to respond to these threats.

LegitScript utilizes various approaches to keep the Internet clean from unregulated drug sellers, monitoring not only domain names, but also their advertisements, affiliate programs, payment processing, and connections to international criminal networks. Our monitoring program is endorsed by the National Association of Boards of Pharmacy (NABP), and LegitScript works with law enforcement agencies worldwide, such as INTERPOL, the US FDA and EU medicine boards.

The illegal online sale of medicines is a threat to citizens’ health and public safety no matter where it happens, including Japan.

日本の医薬品市場はアメリカに続き、世界第二位の規模です。レジットスクリプトは、日本の法規に従わずに処方箋医薬品を販売し、日本人の健康と安全を脅かす日本語ウェブサイトを、過去二年間で400以上閉鎖しました。

日本では最高裁の判決に基づく一般用医薬品（OTC医薬品）のオンライン販売の解禁により、現在国会で医薬品のオンライン販売について新しい法案が審議されています。一般用医薬品のオンライン販売解禁に合わせ、医療用医薬品を違法に販売するウェブサイトのベストケンコーなども、現在はトップページに一般用医薬品を表示し、一般用医薬品を求めている顧客に対し、一般用医薬品と医療用医薬品をセットにして違法に販売するなど、国内市場を狙った動きが出ています。今後、更なる積極的な日本市場への監視が必要となるであろうと我々は予想しています。

レジットスクリプトは未規制の医薬品販売者からインターネットの安全を守るため、ドメイン名だけでなく、広告、アフィリエイトプログラム、決済方法、また、国際犯罪ネットワークとのつながりなど、多角的に調査と監視を行っており、このレジットスクリプトの監視手法はNABP（アメリカ全国薬事評議会連合会）に承認されています。また、レジットスクリプトはインターポール（国際刑事警察機構）、USFDA（アメリカ食品医薬品局）、欧州の医薬品局など、世界中の法施行機関と提携をしています。

オンライン上での医薬品の違法販売は、人々の健康と公共の安全を脅かすものです。それはどこで行われても同じです。日本でも、危険な事に変わりはありません。

1. 中国b89（媚薬）
このネットワークは中国を拠点とし、b89.jp や b89mall.com など、20以上のウェブサイトを運営しています。「b89」は「媚薬」を意味しています。レジットスクリプトは最近、ks0505.comなど、このネットワークに属する１５のウェブサイトを閉鎖しました。このネットワークは主に媚薬やED医薬品などを販売しており、シアリス１００mgのような、危険を及ぼす可能性のある薬を販売しています。シアリスは５mg、１０mg、２０mgしか承認されておらず、シアリス１００mgというのはどこの国でも承認されていません。この商品が万が一「本物」であったとしても、正規品の５倍から２０倍の強さがあり危険である、という事は容易に想像できます。

2. 中国CLV社
このネットワークはclvmall.com や idrugstore.asia や セックスレス対策.comのような、40のウェブサイトを運営しています。違法に処方箋医薬品を販売するだけでなく、 正規品でないと思われるスポーツユニフォームなども日本代表ユニフォーム.com や unifomushop.comで販売しています。ユニフォームを売るウェブサイトと医薬品を違法に売るウェブサイトの両方に0368-63-5416の電話番号が載せてあります。

この電話番号に電話すると、カスタマーサービスは、「お客様は、偽造ED薬を注文しましたか？それとも偽造ニューヨークヤンキースのユニフォームを注文しましたか？」と聞くのでしょうか。

3.イワ貿易
三つ目のネットワークは「イワ貿易」です。このネットワークは中国の福建省に拠点をおき、seiryokuzai.com や x-kanpou.com などのウェブサイトを運営しています。先述の２つのネットワークと同様に、シアリス、レビトラ、バイアグラなどのED医薬品に加え、危険な精力剤や媚薬を販売しています。処方箋医薬品が危険な事は言うまでもありませんが、これらのネットワークが販売する精力剤や媚薬も大変危険です。例えば、「 威哥王 （ウェイカワン）」という名前の精力剤は、鹿、羊、オットセイなどの陰茎や朝鮮人参が原料とありますが、医薬品成分であるシルデナフィルが含まれている事が確認されています。また、媚薬として売られている「紅蜘蛛（べにぐも）」は、天草やクコが成分としてあげられていますが、医薬品成分であるクロザピンが含まれている事が確認されています。シルデナフィルもクロザピンも、処方箋医薬品の成分であり、医者の処方箋の提示を求めずに販売する事は許されていません。

レジットスクリプトはこれらの中国を拠点とする不正薬局から医薬品、媚薬、精力剤などのヘルスケア製品を買わないよう（それにニューヨークヤンキースのユニフォームの偽造品も）、日本の消費者に向けて警告致します。

LegitScript has recently identified three new rogue Internet pharmacy networks based in China that are shipping prescription medicines and tainted dietary supplements into Japan, in violation of Japanese Pharmaceutical Affairs laws and regulations. Online sales of prescription drugs is illegal in Japan, except for very rare occasions. We should note that all the websites in these networks use incorrect Japanese language, and as such it’s obvious that they are operated by non-Japanese speakers. LegitScript urges Japanese consumers not to purchase prescription drugs online. The three networks are:

1. b89 China:
This network has more than 20 websites, such as b89.jp and b89mall.com. “b89” reads as “Biyaku,” which means “aphrodisiac” in Japanese. LegitScript recently shut down 15 websites in this network, including ks0505.com. This network is selling tainted “aphrodisiac” and prescription erectile dysfunction medicines. Products that this network sells, such as Cialis 100mg, are potentially dangerous. Only 5mg, 10mg and 20mg are approved, and Cialis 100mg is not approved anywhere in the world. Even if it is genuine, it’s not hard to imagine how dangerous this product is, as it’s five to 20 times stronger than the approved products.

2. CLV China:
This network of 40 active Internet pharmacy websites includes the flagship websites clvmall.com, idrugstore.asia and セックスレス対策.com. They not only sell prescription medicines illegally, but they also sell sports team uniforms that are most likely unlicensed at 日本代表ユニフォーム.com and unifomushop.com. Both the uniform shop and the rogue Internet pharmacy website have the same phone number: 0368-63-5416. unifomushop.com shows the telephone number 0368-63-5416:

Does the customer service representative ask if customers have ordered a fake ED medicine, or fake New York Yankees uniform?

3. Iwa Trading:
The third new network we identified is the “Iwa Trading.” This network is based in Fujian province in China and operates websites such as eseiryokuzai.com and x-kanpou.com. Just like the two networks discussed earlier, this network sells ED drugs such as Cialis, Levitra and Viagra, as well as tainted male enhancement pills and aphrodisiacs. Not to mention these prescription drugs are dangerous, male enhancement pills and aphrodisiac they sell also pose hazards to public safety. For example, the male enhancement pills named “威哥王 (wei ge wang),” which claim to be made of “natural” substances such as dried penis of deer, sheep and seal, and ginseng root, were found to contain sildenafil. Aphrodisiac “紅蜘蛛 (Benigumo),” which claims to be made of licorice and matrimony vine, was found to contain clozapine. Both sildenafil and clozapine are prescription drug ingredients, and are not allowed to be sold without doctor’s prescriptions.

LegitScript warns Japanese consumers to avoid purchasing healthcare products including medicines, aphrodisiacs and male enhancement supplements (and, also, counterfeit NY Yankees uniforms) from these China-based rogue Internet pharmacy websites.

レジットスクリプトは、最大規模の犯罪組織であるベストケンコー（前ベストくすり）のウェブサイトの執行に成功し、ベストケンコーが保有している bestkenko.com や kusuriexpress.net などを含む、複数のウェブサイトを閉鎖しました。

昨日まではこのように堂々と薬事法違反を行っていました。

今日の時点で同サイトはこのように閉鎖状態となりました。

ベストケンコーは日本国民を標的とする最大の不正医薬品販売組織です。レジットスクリプトはこの犯罪組織がアフィリエイトウェブサイトを含め、350以上のウェブサイトを運営している事を把握しています。これら350以上のウェブサイトは全てbestkenko.com または kusuriexpress.net にリンクし、この二つのどちらかのウェブサイトを通して不正販売を行っていました。今回この二つのウェブサイトを閉鎖した為、今日の時点で350のウェブサイト全てが違法販売を行う事ができなくなっています。

今回閉鎖に成功したベストケンコーのウェブサイトはShkrawar Peth, Puneという住所のもと、「Vaijanti Pharma」という社名、「Amruta Krishna Kenge」という個人名でドメイン名登録されていました。言うまでもありませんが、もしこのドメイン名登録者がインドでなんらかの医薬品販売許可書を持っていたとしても、ベストケンコーが日本の法律に明らかに違反して運営されている事に変わりはありません。

ベストケンコーはドメイン名と店舗名を変え、また違法営業を再開するでしょう。実際にレジットスクリプトは過去にこの犯罪組織が運営していた bestkusuri.com を閉鎖しましたが、同様のウェブサイトが後にbestkusuri.net として戻ってきました。その後我々はまた同様に彼らの bestkusuri.net を閉鎖しましたがこれも bestkenko.com と kusuriexpress.net として戻ってきました。レジットスクリプトが今回これらを再度閉鎖した今、ベストケンコーはまた慌ただしく、新しいドメイン名を探し、新しい名前のロゴを作っていることでしょう。

レジットスクリプトはベストケンコーが日本国民の健康と安全を脅かす違法営業を止めるまでベストケンコーを追いかけ続けます。

レジットスクリプトはベストケンコー運営者に対し、不正医薬品販売ウェブサイトの運営を止めるよう警告します。

また、レジットスクリプトはベストケンコーのような不正業者から処方箋なしで海外から処方箋医薬品を買うことを止めるよう、日本国民の皆様にお願い申し上げます。もしあなたがベストケンコーから購入した薬を使用し健康被害があったとしても、ベストケンコーのような犯罪組織は誠意を持った対応はしないでしょう。

LegitScript seeks to help protect public health on a global scale by notifying domain name registrars about cybercriminals selling unregulated, often unsafe medicines. Most of the world’s ~1,000 domain name registrars terminate services to these “rogue Internet pharmacies,” thus shutting down the websites and making the Internet safer.

But a few registrars do not. Today, LegitScript released a report about one such company, GMO Internet, which by our estimate sponsors about 66% of the illegal online pharmacies targeting Japan.

As we explain in our report, GMO Internet has repeatedly been notified that its services are used by rogue Internet pharmacies putting Japanese citizens’ health and safety at risk. In an effort to work with GMO Internet and explain how most other registrars around the world deal with the problem — by terminating services to cybercriminals — we’ve done everything we can think of. We’ve written numerous emails identifying the illegal online pharmacies. We’ve mailed a certified letter. We’ve submitted memoranda explaining the problem. We’ve even flown to Japan to try to meet with them in person.

The same response was provided by GMO in every case, in essence: We aren’t interested in doing much about this, so go away and complain to someone else. Yet all the while, GMO Internet has quietly continued its business relationships with the rogue Internet pharmacies — a practice wholly out of step with most other domain name registrars around the world.

This is important, and unfortunate, for a few reasons.

First, Japan is the world’s second-largest target of cybercriminals selling unregulated medicines (the US is the first). About 10% of the Internet’s rogue pharmacies are written in Japanese, and another 75% or so offer to ship to Japan, along with other countries. There are multiple instances in Japan and globally of deaths and serious health consequences from the use of illegally marketed unapproved drugs, making GMO Internet’s neglect a serious problem.

Second, it does not have to be this way, a fact proven by how most registrars aside from GMO Internet respond to abuse complaints. Registrars in Japan, such as NetOwl, and abroad, like GoDaddy (US), eNom (US), Directi (IN), Blacknight (IE), BizCN (CN), Realtime Register (NL), and many others responsibly terminate services to illegal online pharmacies targeting Japan, even though those registrars are located in other jurisdictions. In other words, the irony is that these foreign companies are doing more to protect Japan’s public health than a leading Japanese company is.

Third, GMO Internet identifies itself as “The Internet Group that represents Japan” (日本を代表する総合インターネットグループへ). And so it does: as the largest domain name registrar in Japan, it is often seen outside of Japan as a representative of the Japanese Internet community and of Japan itself. As one of the few registrars that refuses to terminate services to domain name owners illegally marketing unapproved drugs, it is hard to see how the company represents Japan well.

LegitScript’s report outlines the numerous steps that LegitScript has taken to work with GMO Internet, and also provides examples of the illegal online pharmacy websites that continue to receive a safe haven from the Japanese registrar. It also outlines the response from GMO Internet and the company’s continuing registration of illegal online pharmacies. In releasing this report, we hope to shine a light on why the illegal online pharmacy problem persists, not only globally but also in Japan.

GMO Internet, and the public, should understand that GMO’s response and apparent insistence on continuing to provide services to website operators illegally marketing unapproved drugs is out of step with other domain name registrars around the world. Most of the global registrar community should be applauded for its voluntary actions in the online pharmacy space. In contrast, GMO Internet’s approach is a minority one — but as long as there are a few registrars like GMO Internet, cybercriminals will have a place to go, and Japanese residents who buy drugs online will remain at risk.

弊社レジットスクリプトは公共の安全を守る世界規模の活動として、ドメイン名レジストラに無規制で危険な医薬品を販売するサイバー犯罪を行うウェブサイトを閉鎖するように要請を行っています。ウェブサイトにドメイン名を提供する「ドメイン名レジストラ会社」は世界に約千社ほど存在します。その大多数は弊社が通知する不正インターネット薬局ウェブサイトを積極的に閉鎖し、インターネットの安全性を高める事に貢献しています。

しかしながら、少数のレジストラは、危険な医薬品を販売するウェブサイトを閉鎖しません。日本最大のレジストラである「GMOインターネット」は、そのような非協力的な会社の一つです。レジットスクリプトはGMOインターネットについてのレポートを発表しました。日本に向けて不正に医薬品を販売するウェブサイトの約66%がGMOインターネットに登録されているとレジットスクリプトは推定しています。

レポートでも述べたように、不正医薬品販売ウェブサイトがGMOのサービスを悪用し、日本国民の健康と安全が脅かしているという通知、またウェブサイトの閉鎖要請を、GMOインターネットは何度も受け取っています。弊社レジットスクリプトはGMOインターネットに対し、世界中の大多数のレジストラはサイバー犯罪者にサービスを提供するのをやめている、と説明するため、あらゆる方法を試みました。メールで幾度となく違法薬局ウェブサイトについての通知を行いました。書留で手紙も送りました。何度も問題について説明しました。面会しようと日本にも行きました。

しかし、私たちの全ての試みに対し、GMOインターネットは「これはGMOインターネットの問題ではない。私たちではなく、他の所に言いなさい。」という返答を毎回繰り返しています。その間にも、静かにGMOインターネットは不正インターネット薬局とビジネス関係を持ち続けています。このGMOインターネットの対応は、世界中のほとんどのドメイン名レジストラが取る姿勢から大きく外れたものです。

これは次に挙げるいくつかの理由から、重大な問題であり、また、これは非常に残念な事実です。

第一に、無規制の医薬品を売るサイバー犯罪者にとって、日本はアメリカに続き、世界で第２位の標的となっています。世界の約10%の不正インターネット薬局ウェブサイトは日本語であり、その他75%は日本語ではありませんが、他の国と共に日本に向けても配送を行っています。日本をはじめ、世界中で違法に販売された未承認医薬品によって、死亡した例や重体になった例が報告されています。これは深刻な問題です。

第二に、GMOの対応は適切でない、という事です。これは、ネットオウルのような日本のレジストラ、また、GoDaddy（アメリカ）、ENom（アメリカ）、Directi（インド）、Blacknight（アイルランド）、Realtime Registrar（オランダ）、その他、世界中のほとんどのドメイン名レジストラは、日本の司法管轄に位置していなくても、日本語の違法インターネット薬局に対してサービスの停止を行っている、という事実によって証明されます。言い換えれば、日本を代表する日本のインターネット会社より、外国の会社の方が、日本国民の健康を守る取り組みを実施しているという事です。これは皮肉な事です。

第三に、GMOインターネットは自らが「日本を代表する総合インターネットグループへ」というスローガンを掲げています。GMOは紛れもなく、日本最大規模のドメイン名レジストラです。日本国外からも日本のインターネット界を代表する会社として認識されています。この「日本を代表する」GMOインターネットが、違法に未承認医薬品を広告、販売するウェブサイトを停止するのを拒絶する世界規模で見ても非常に稀なドメイン名レジストラである事は、残念な事です。

このレジットスクリプトのレポートでは、弊社レジットスクリプトがGMOインターネットに対して行った数々の働きかけについて記述すると共に、GMOインターネットを利用して違法行為を続けているオンライン薬局ウェブサイトの例を挙げています。また、GMOインターネットからの返答と、GMOインターネットが違法オンライン薬局を登録し続けている事実についても述べています。レジットスクリプトは、このレポートが、なぜ日本を含む世界中で違法インターネット薬局の問題が現在も続いているのか、という点に光を当てる事を期待しています。

GMOインターネットから弊社への返答、また、違法インターネット薬局に対してサービスの提供を続けるというGMOインターネットの強い姿勢は、世界中のドメイン名レジストラの取り組みからかけ離れたものである、という事をGMOインターネットと日本国民は知るべきでしょう。世界中のほとんどのレジストラがインターネット薬局に対しての監視と対策を行っており、その自主的な行動は賞賛に値すべきです。それに反し、GMOインターネットは少数派の非協力的な対応を取っています。GMOインターネットのようなレジストラが少数でも存在し続ける限り、サイバー犯罪を行う者は隠れ続けます。その結果として、インターネットで医薬品を購入する日本人には危険性が付きまとうのです。
